In a workshop with the Supreme Court and Attorney General's Office, FEM explained why press council complaints mechanisms are so important.

Good for journalists

• Protects good journalists.
• Judges them on professional mistakes.
• Reduces risk of slow, expensive court process.

Good for media

• Improves public credibility of media.
• Improves competition between media companies as readers will change if failures in accuracy and truthfulness.

Good for public

• Quality insurance.
• Complaints are free, unlike courts.
• Fast and public remedy (especially good for politicians).
• Still have right to go to courts.

Good for judicial sector

• Removes cases from court backlog.
• Removes politically-sensitive cases from courts.
• Encourages mediation before court.
• Avoids court standards of proof, which stifle political discourse.

Good for democracy

• Encourages dealing with disputes in a rational and fair manner.
• Imposes democratic political culture and promotes processes independent of government.
• Facilitates transition from media controlled by government to media controlled by civil society.

But

• Self-regulation must protect people. Should not be judicial void.
• Self-regulation needs to establish trustworthy journalism and stop sensationalism (What the public thinks is journalism, not what the government thinks!).
• Self-regulators need support from government, judges, prosecutors, etc., to “put their house in order”.
