ရာဇသတ်ကြီး ပုဒ်မ ၅၀၅-က ကဲ့သို့သော “သတင်းအမှား”ဖြင့် တရားစွဲဆိုခံရသည့် အမှုများကို တရားရုံးတွင် ခုခံချေပရန်အတွက် အသုံးဝင်သော ခုခံချေပရေး ဗျူဟာများကို လွတ်လပ်စွာထုတ်ဖော် ပြောဆိုခြင်း မြန်မာ  (FEM) ၏ လက်စွဲစာအုပ်အသစ်တွင် ထည့်သွင်း ဖော်ပြထားသည်။ 

ရာပေါင်းများစွာသော အပြစ်မဲ့ စာနယ်ဇင်းသမားများ၊ လူ့အခွင့်အရေးကာကွယ်သူများ၊ တက်ကြွလှုပ်ရှားသူများ၊ Facebook အသုံးပြုသူများ၊ ဆန္ဒထုတ်ဖော်သူများနှင့် နိုင်ငံရေးသမားများသည် ၎င်းတို့၏ လွတ်လပ်စွာ ထုတ်ဖော်ပြောဆိုခွင့်ကို ကျင့်သုံးခြင်းနှင့် စစ်အာဏာသိမ်းမှုကို ဆန့်ကျင်ခြင်းတို့ကြောင့် ပုဒ်မ ၅၀၅-က အပါအဝင်  မြန်မာနိုင်ငံ၏ ဒီမိုကရေစီနှင့်ဆန့်ကျင်သည့် “သတင်းအမှား”ဆိုင်ရာဥပဒေများအရ ဖမ်းဆီးခြင်း၊ တရားစွဲဆိုခြင်းနှင့် ပြစ်ဒဏ်ချမှတ်ခြင်း ခံခဲ့ရသည်။  

ဤ “မြန်မာနိုင်ငံအတွင်း သတင်းအမှားဆိုင်ရာ တရားခံရှေ့နေလက်စွဲ”ကို မြန်မာနိုင်ငံတွင် အမြစ်တွယ်နေသော မတရားသည့် တရား‌ရေးစနစ်ကို တစ်လှမ်းခြင်း ခုခံတွန်းလှန်နေမှု၏ အစိတ်အပိုင်းတစ်ခုအဖြစ်  တရားစွဲဆိုခံရသူများ၊ ရှေ့နေများ နှင့် ၎င်းတို့ကိုထောက်ခံသော အရပ်ဘက်လူမှုအဖွဲ့အစည်းများက မိမိကိုယ်ကို “သတင်းအမှား”ဆိုင်ရာ စွပ်စွဲချက်များမှ ကာကွယ်နိုင်အောင် အားပေးကူညီရန်ဟူသော ရည်ရွယ်ချက်ဖြင့် ရေးသားထားခြင်း ဖြစ်သည်။

လက်စွဲစာအုပ်တွင် (၁) သက်ဆိုင်ရာနိုင်ငံတကာ စံနှုန်းများ၊ (၂) မြန်မာနိုင်ငံအခြေအနေနှင့် ဥပဒေများ၊ (၃) ဖမ်းဆီးခြင်း၊ ထိန်း သိမ်းခြင်း သို့မဟုတ် တရားစွဲဆိုခြင်းခံရပါက သင့်တွင်ရှိသော အခွင့်အရေးများ နှင့် ရွေးချယ်စရာများ၊ (၄) ဖြစ်နိုင်ခြေရှိသော ဥပဒေအရ ခုခံချေပရေးဗျူဟာများ စသည်တို့နှင့်ပတ်သက်သော လမ်းညွှန်ချက်များ ပါဝင်သည်။ စာမျက်နှာ တစ်ခုစီတိုင်းကို မြန်မာဘာသာဖြင့် ရေးသားထားပြီး ပိုမိုလေ့လာနိုင်ရန်နှင့် မတူညီသော ဖတ်ရှူအသုံးပြုသူများနှင့် ဆက်သွယ်ပြောဆိုရာတွင် အထောက်အကူဖြစ်စေရန် အင်္ဂလိပ်ဘာသာဖြင့်လည်း ထပ်မံဖော်ပြထားသည်။ 

ဤလက်စွဲစာအုပ်သည် မိမိတို့၏လွတ်လပ်စွာ ထုတ်ဖော်ပြောဆို ခွင့်ကို ကျင့်သုံးသောကြောင့် ရာဇဝတ်မှုဖြင့် တရားစွဲဆိုခြင်းခံထား ရသော သူများအား အထောက်အပံ့များ ကူညီပံ့ပိုးပေးနေသည့်  လွတ်လပ်သော ထုတ်ဖော်ပြောဆိုခြင်း မြန်မာ (FEM) ၏ လုပ်ငန်း အစိတ်အပိုင်းတစ်ခုဖြစ်သည်။ ယင်းတို့တွင် သတင်းသမားများ၊ ဆန္ဒထုတ်ဖော်သူများ၊ တက်ကြွလှုပ်ရှားသူများ၊ လူ့အခွင့်အရေး ကာကွယ်သူများ၊ အရပ်ဖက်အဖွဲ့အစည်းမှ ဝန်ထမ်းများ၊ ဖေ့စ်ဘွတ်(ခ်) သုံးစွဲသူများ အပါအဝင် တရားရင်ဆိုင်နေရသူများ (သို့မဟုတ်) တရားစွဲဆိုခံရနိုင်သည့် အခြေအနေတွင် ရောက်ရှိနေသူ မည်သူမဆို အကျုံးဝင်ပါသည်။

FEM’s new toolkit provides useful legal strategies to defend in court against “false news” charges such as Article 505A.

Myanmar’s anti-democratic “false news” laws, including Article 505A, are used to arrest, charge, and sentence hundreds of innocent journalists, human rights defenders, activists, Facebook users, protesters, and politicians for exercising their right to freedom of expression and opposing the coup. 

The “Defence Lawyers’ Toolkit for ‘False News’ Cases in Myanmar” empowers defendants, lawyers, and their civil society supporters to defend themselves against allegations of “false news” as part of an incremental resistance against Myanmar’s deeply unjust legal system. 

The Toolkit includes guidance on: 1) relevant international standards; 2) the situation and laws in Myanmar; 3) your rights and options when detained, arrested, or charged; 4) potential legal defence strategies. Each page is written in Myanmar but repeated in English to enable further research and communication with different audiences too. The Toolkit is part of FEM’s work supporting those being prosecuted for exercising their right to freedom of expression. This includes anyone prosecuted or facing a risk of prosecution, and will cover anybody including journalists, protesters, activists, human rights defenders, CSO workers, and Facebook users.
